Terms of Service
These terms are the agreement between you and Blurtd when you use our app or website. Plain enough that you'd actually read it; specific enough to matter if anything goes sideways.
1. Accepting these terms
By creating an account, joining a room as a guest, or otherwise using the Blurtd mobile app or website (the "Service"), you agree to these Terms of Service ("Terms") and our Privacy Policy. If you don't agree, don't use the Service.
If you're using Blurtd on behalf of an organization (e.g., for a TeamSpace), you represent that you have authority to bind that organization to these Terms.
2. What Blurtd is
Blurtd is a real-time social party game. One player connects a streaming platform (TikTok now; Instagram Reels and YouTube Shorts later), the room sees one of that player's liked videos per round, and everyone else votes on who liked it. We also offer a B2B "TeamSpace" mode for HR and event teams that lets admins upload clips manually instead of connecting socials.
3. Eligibility
- You must be at least 13 years old (16 in the European Economic Area / United Kingdom). We recommend the Service for users 18 and over because liked-feed content is unpredictable and may not be appropriate for minors.
- You must not be barred from using the Service under the laws of your country, the United States, or the country where you reside.
- You agree to provide accurate information when signing up.
4. Your account
You can use Blurtd in two ways:
- As a guest, by joining a room with a PIN. No account required, no platform connection required.
- As a signed-in user, with email-based authentication. Required to be the source player for any TikTok-driven round.
You're responsible for safeguarding your account credentials. Notify us promptly at hello@blurtd.app if you believe your account has been accessed without authorization.
5. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose, or in any way that violates these Terms.
- Harass, threaten, defame, or impersonate any other person.
- Submit content (including display names) that is obscene, hateful, infringing, or otherwise illegal.
- Attempt to gain unauthorized access to any part of the Service, other accounts, or our infrastructure.
- Reverse engineer, decompile, or disassemble the app, except where this restriction is prohibited by applicable law.
- Use bots, scrapers, or automated tools to interact with the Service without our written permission.
- Resell, sublicense, or redistribute the Service, in whole or in part.
- Circumvent rate limits, paywalls, or other access controls.
- Probe, scan, or test the vulnerability of the Service in ways that disrupt other users.
- Use the Service to collect personal information about other users for purposes outside the game (e.g., harvesting display names for marketing).
6. User content & rooms
When you join a room, you may share content with the other players: your display name, your votes, and — if you're the source player — references to your liked clips on a connected platform. You retain ownership of anything you create. By providing it through the Service, you grant Blurtd a worldwide, non-exclusive, royalty-free license to use, host, display, transmit, and process that content solely for the purpose of operating the Service.
You agree not to share, in any room or in any user-set field, content that violates section 5 (Acceptable use). Hosts of TeamSpace rooms are responsible for the conduct of their members.
We don't pre-screen user content. We may, but are not required to, remove content or terminate accounts that violate these Terms.
7. Connected platforms
When you connect TikTok (or, in the future, Instagram or YouTube), you authorize Blurtd to access your liked-clip metadata via that platform's official API. The connection is governed by:
- The platform's own terms (TikTok Terms of Service, Instagram Terms of Use, YouTube Terms).
- Our Privacy Policy, which explains what we receive and store.
You can disconnect a platform at any time inside the app. We'll delete the stored refresh token within 7 days. The platform may continue to retain its own logs of the connection per its own policies.
We don't claim any ownership over content streamed from a connected platform. The clips your room sees are streamed directly from the platform's CDN; Blurtd is the matchmaker, not the publisher.
8. Subscriptions & payments
Blurtd offers three consumer plans and one B2B plan:
- Pro Weekly — recurring weekly subscription, currently $2.49 USD/week (varies by region).
- PartyPass — one-time purchase, currently $6.99 USD, unlocks unlimited rounds for a single event.
- Lifetime — one-time purchase, currently $19.99 USD.
- TeamSpace — monthly B2B plan starting at $99 USD/month, billed separately. Contact us for terms.
All consumer plans are processed through the App Store (iOS) or Google Play Store (Android) and managed by our subscription provider RevenueCat. Prices may vary by country and currency. We may change pricing at any time; existing subscriptions continue at their original price until the next renewal cycle, at which point you'll be notified before any change takes effect.
Subscriptions auto-renew unless you cancel at least 24 hours before the end of the current period. The renewal will be billed to the payment method on file with the App Store / Play Store.
9. Cancellation & refunds
You can cancel a recurring subscription at any time:
- iOS: Settings → Apple ID → Subscriptions.
- Android: Play Store → Profile → Payments & subscriptions → Subscriptions.
Cancellation stops the next renewal but does not retroactively refund the current period. Refunds are handled by Apple and Google according to their policies; Blurtd does not directly issue consumer refunds. For TeamSpace plans, contact hello@blurtd.app.
Where local law (e.g., the EU consumer rights directive) gives you a withdrawal right within 14 days of purchase, you can exercise that right by contacting us, and we'll work with the App Store / Play Store as required.
10. Intellectual property
The Blurtd name, logo, "ribbon" design system, app interface, and underlying code are owned by Blurtd or our licensors and are protected by copyright, trademark, and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes (or the commercial purposes covered by an active TeamSpace plan).
You may not copy, modify, distribute, sell, or lease any part of the Service, except as expressly permitted in these Terms.
11. Third-party services
The Service depends on third-party services including (but not limited to) Apple, Google, TikTok, Instagram, YouTube, Supabase, RevenueCat, Sentry, Mixpanel, Cloudflare, and Expo. Their availability, performance, and policies are outside our control. We're not liable for any failure of a third-party service that affects your use of Blurtd.
Links to third-party websites are provided for convenience. We don't endorse and aren't responsible for their content or practices.
12. Termination
You can stop using Blurtd at any time. If you have an account, delete it from in-app settings or email hello@blurtd.app.
We may suspend or terminate your account if we reasonably believe you've violated these Terms, posed a risk to the Service or other users, or if we are required to do so by law. Where practical and appropriate, we'll notify you and give you a chance to remediate.
Sections that by their nature should survive termination (intellectual property, disclaimers, limitation of liability, governing law) will continue in effect.
13. Disclaimers
The Service is provided "as is" and "as available." To the maximum extent permitted by law, Blurtd disclaims all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy.
We don't warrant that the Service will be uninterrupted, error-free, secure, or that any defects will be corrected. We don't warrant the accuracy or reliability of any content streamed from a connected platform — that content belongs to the platform, not to us.
14. Limitation of liability
To the maximum extent permitted by law, Blurtd, its directors, employees, agents, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Service, even if we've been advised of the possibility.
Our total cumulative liability for any claim relating to the Service will not exceed the greater of (a) the amount you paid us in the twelve months before the claim arose, or (b) USD $100.
Some jurisdictions don't allow the exclusion of certain warranties or limitations of liability for incidental or consequential damages, so the above may not apply to you in part or in full.
15. Indemnification
You agree to defend, indemnify, and hold harmless Blurtd and its affiliates from any claim, demand, loss, liability, or expense (including reasonable legal fees) arising out of (a) your use of the Service in violation of these Terms, (b) your violation of any law or third-party right, or (c) any content you submit to the Service.
16. Disputes & governing law
These Terms are governed by the laws of [Jurisdiction TBD — owner to confirm], without regard to conflict of laws principles. Any dispute arising from these Terms or your use of the Service will be resolved in the courts located in [Jurisdiction TBD], unless mandatory consumer-protection laws of your country of residence give you a different right.
Heads up: the jurisdiction placeholders above need to be set by Blurtd's legal counsel before publication. Until then, treat this section as a draft.
If you're a consumer in the European Union, you may also use the EU's Online Dispute Resolution platform.
17. Changes to these terms
We may update these Terms from time to time. The "Effective" date at the top reflects the latest version. For material changes, we'll notify you in the app or by email at least 14 days before the change takes effect, where reasonably possible. Continued use of the Service after the effective date means you accept the new Terms.
